On January 1st, 2013, in New Hampshire, the new Driving Under the Influence (DUI) Laws and penalties went into effect. The definition of “under the influence” was expanded to include not only the traditional liquor and controlled drugs but now encompasses prescription drugs, over-the-counter drugs and any chemical substance, natural or synthetic, that impairs a person’s ability to drive. 

Depending on the circumstances of the case and the level of an offense, DUIs can lead to jail time, fines, and court-appointed treatment or probation. Penalties of New Hampshire DUIs 

The nature and scope of penalties depend upon the level of offense. If convicted, jail time, fines, and loss of driving privileges are the result of a DUI charge. In many cases, jail time is suspended, provided you participate in the Impaired Driver Care Management Program. 

However, many aspects of the penalty phase remain, especially in severe cases or upon subsequent offenses occurring within a short period. Upon conviction, you face a mandatory jail sentence, expensive fines, license loss, reinstatement fees at the DMV, a damaged motor vehicle record, and insurance requirements. New Hampshire does not have a “Cinderella” or hardship license.

Penalties in New Hampshire DUI cases include:

  • First offense DWI: Punishable with fines and license suspensions. This may include $500 to $1,200 in fines and a nine to twelve-month license suspension. 
    • Second offense DWI: Punishable by up to one year in jail time, $750 to $2,000 in fines, and up to three years of license suspension. 
  • Subsequent offense DWIs: Punishable by up to one year in jail time, up to $2,000 in fines, and a lifetime license revocation.  
  • Class A Misdemeanor/aggravated DUI: From five days to one year of jail time and up to a $2,000 fine. 
  • Class B Felony/aggravated DUI: Up to seven years in jail and up to $4,000 in fines.
  • Probation: At times, a judge may suspend a portion of a DUI offender’s jail sentence and require them to be on probation for up to two years.  

Individuals under twenty-one years of age convicted of a DWI offense are also subject to penalties under NH DUI laws.
